By signing up, logging in, creating an account, submitting a loan request, or using the service, the above user also known as a borrower (individually, an “Applicant”) acknowledges and agrees that: 1) all information provided to PropertyGo is accurate and complete; 2) he/she will immediately notify PropertyGo of any change in such information; 3) PropertyGo may share all information and documents, excluding consumer credit reports, to other entities (“Assignees”) in order to fulfill PropertyGo’s obligations to the Applicant; 4) PropertyGo and Assignees may rely on the accurateness of the information provided; 5) each Applicant represents that he or she is authorized to sign this form on behalf of the Borrower; 6) he/she waives and releases any claims against any information provider relating to the release of information; and 7) PropertyGo and Assignees have my/our express written permission to contact me/us at the number and email provided in this application via email, telephone, text message (SMS/MMS) and/or cellular phone (including use of automated dialing equipment and pre-recorded calls and/or messages), which consent is not a condition of receiving services from PropertyGo.
PropertyGo matches commercial real estate borrowers (or potential borrowers) with active banks, lending platforms, financial institutions, and other lending sources. Through a proprietary matching technology, PropertyGo helps commercial real estate borrowers to identify the loan category and specific lender(s) that offer the best opportunity for that borrower to prepare for and acquire a loan. Once prepared, commercial real estate borrowers are then introduced to the most appropriate lending source via our proprietary technology. Changes to these Terms
Please check these Terms periodically for changes because we reserve the right, in our sole discretion, to change, modify, add or remove portions of these Terms. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. All text, graphics, user interfaces, visual interfaces, photographs, trademarks (whether registered or not), logos, sounds, artwork of any kind, and computer code (collectively, “Content”), including but not limited to the design, structure, coordination, selection, appearance, and arrangement of the Content, contained on the Site is owned by PropertyGo and is protected by trade dress, copyright, trademark, and other property laws and unfair competition laws. Any misuse of the Content will be at your peril and PropertyGo will do all that is lawful to enforce and protect the Content.
As used in these Terms, the following words shall have the following meanings. “PropertyGo” includes “PropertyGo, Inc.”, “PropertyGo”, “we”, “us” and variations such as “our”. “Service” includes the products, services and software that you order, receive or access as part of the PropertyGo service.
As a user of the Site or a user registered to use any of the Services (a “Registered User”), you agree to the following: a. Exclusive Use. Your account is to be used only by you and only for your commercial real estate borrowing / loan needs. You may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You acknowledge that PropertyGo is not responsible for third-party access to your account that results from theft or misappropriation of your user name and passwords.
b. Information Submitted. You are solely responsible for, and assume all liability regarding (i) the information and content you provide through your use of the Site and any Services, (ii) the information and content you make available in any manner through the service, and (iii) your interaction with any and all third-parties. Any attempt to enter information to create a duplicate account will be rejected and your account will be put on hold.
c. Risk Assumption and Precautions. You assume all risk when using the Services, including but not limited to all of the risks associated with any interactions with third-parties, including but not limited to any lenders to which you are matched, referred or provided.
d. No Guarantees. PropertyGo may not be able to provide matches for every Registered User seeking to use its services. Further, PropertyGo makes no guarantees as to the number of matches or the ability to obtain commercial real estate funding.
e. No False Information. You agree to provide accurate, true, current and complete information.
f. Legal Purpose. You agree to not use the Site or Services for any illegal purpose. You will only use the Site or Service in accordance with federal, state and local laws.
g. Business Purpose. You agree to only use the Site or Services for a bona fide business purpose. You agree not to use the Site or Services for personal, family or household purposes. You may not use the Site or Services to obtain information about or make decisions about anyone but yourself and/or your business.
a. Ownership of Proprietary Information. You hereby acknowledge and agree that PropertyGo is the owner of all rights in and to the Site and Services. Federal, state, and local laws and regulations protect these proprietary rights. You are permitted to use the Site and Services only as expressly authorized by these Terms. You may not copy, reproduce, distribute or create derivative works, reverse engineer or reverse compile any of the Site or Services or technology.
b. No Use of Confidential Information. You will not post, copy, modify, transmit, disclose, show in public, create any derivative works from, distribute, make commercial use of, or reproduce in any way any (i) confidential information or (ii) other copyrighted material, trademarks, or other proprietary information accessible via the Site or Services, without first obtaining the prior written consent of the owner of such proprietary rights.
c. License to Provided Content. By providing information or content to any account or public area of the Site or Service, you automatically grant, and you represent and warrant that you have the right to grant, to PropertyGo and its users, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, reproduce, publicly perform, publicly display and distribute such information and content, and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing. From time to time, we may create, test or implement new features or services on the Site in which you may voluntarily choose to participate, in accordance with the additional terms and conditions of such features or programs. By your voluntary participation in such features or programs, you grant us the rights stated in this subsection in connection with the additional terms and conditions (if any) of such features or services.
b. Disclosure by Law. You acknowledge and agree that PropertyGo may disclose information you provide if required to do so by law, at the request of a third-party, or if we, in our sole discretion, believe that disclosure is reasonable to (i) comply with the law, requests or orders from law enforcement, or any legal process (whether or nor such disclosure is required by applicable law); or (ii) protect or defend PropertyGo’s, or a third-party’s, rights or property.
c. Information Security. We work hard to protect PropertyGo and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:
d. Use of Anonymous Information for Research. By using the Site and/or Services, you agree to allow PropertyGo to anonymously use the information from you and your experiences through the Services to continue PropertyGo’s research into successful business practices and to improve the Services.
e. License Regarding Your Content. You retain all ownership interest in and to the content you provide to the Site or as part of your use of the Services. However, by submitting your content, including your personal and business information, you hereby grant to PropertyGo a perpetual, non-exclusive, irrevocable, royalty-free license to: reproduce, adapt, edit, modify, translate, publish, transfer, and/or distribute any of your content. This license specifically includes the right for PropertyGo to make such content available to other trusted companies, organizations, and/or individuals with whom PropertyGo has a business relationship in order to carry out the performance of the Services. As part of its performance of the Services, PropertyGo may (i) transmit or distribute your information over various public networks and in various forms; and (ii) make necessary changes to your content in order to perform its obligations.
PropertyGo offers a free subscription service to assist you with your commercial real estate financing needs. As explained above, PropertyGo matches you with various potential lenders and loan products to meet your needs. As part of the Services, we request and you provide various items of information to be used in order to provide the best match for your business needs.
a. No Warranties. THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. PROPERTYGO PROVIDES THE SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. PROPERTYGO DOES NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE OR WILL MEET YOUR REQUIREMENTS, OR THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED. PROPERTYGO DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, THE CONNECTIVITY AND AVAILABILITY OF THE SERVICES.
b. Third-Party Content. Opinions, advice, statements, offers, or other information or content made available through the Site or Services, but not directly by PropertyGo, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. PROPERTYGO DOES NOT: (i) GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SERVICES, OR (ii) ADOPT, ENDORSE OR ACCEPT RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY ANY PARTY OTHER THAN PROPERTYGO. UNDER NO CIRCUMSTANCES WILL PROPERTYGO BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE’S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE SITE OR SERVICES, OR TRANSMITTED TO OR BY ANY USERS.
c. Beta Features. From time to time, PropertyGo may offer new “beta” features or tools with which its users may experiment on the Site or Services. Such features or tools are offered solely for experimental purposes and without any warranty of any kind, and may be modified or discontinued at PropertyGo’s sole discretion. The provisions of this Disclaimer of Warranty section apply with full force to such features or tools.
a. Incidental Damages and Aggregate Liability. IN NO EVENT WILL PROPERTYGO BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES, EVEN IF PROPERTYGO KNOWS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL PROPERTYGO’S AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS TERMS OR THE USE OF THE SERVICES OR SITE, EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT OR SUBSCRIPTION, OR, IF YOU HAVE NOT PAID PROPERTYGO FOR THE USE OF ANY SERVICES, THE AMOUNT OF US$25.00 OR ITS EQUIVALENT.
b. No Liability for non-PropertyGo Actions. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROPERTYGO BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES.
c. Information Verification. PropertyGo and its contractors may use various methods of verifying information that users have provided. However, none of those ways are perfect, and you agree that PropertyGo and its contractors will have no liability to you arising from any incorrectly verified information.
You agree to indemnify, defend and hold harmless PropertyGo, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of (i) your use of or inability to use the Site or Services, (ii) any user postings made by you, (iii) your violation of any terms of these Terms or your violation of any rights of a third-party, or (iv) your violation of any applicable laws, rules or regulations. PropertyGo reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with PropertyGo in asserting any available defenses.
This agreement will become effective upon your acceptance of the Terms by your use of the Site or Services and will remain in effect in perpetuity unless terminated hereunder. Either you or PropertyGo may terminate your account at any time, for any reason or no reason, without explanation, effective upon written notice to the other party. PropertyGo reserves the right to immediately suspend or terminate your access to any of the Services, without notice, for any reason or no reason. We also reserve the right to remove your account information or data from our Services and any other records at any time at our sole discretion. In the event your access to any of the Services is suspended due to the breach of this Terms, you agree that all fees then paid to PropertyGo by you will be nonrefundable and all outstanding or pending payments will immediately be due. You may terminate your account by following the steps in the applicable section under “Cancellations” below.
Cancellation At Any Time. The cancellation procedures in this section do not apply to any lender that has entered into an Agreement with PropertyGo. The terms of cancellation for lenders will be contained in a separate Agreement. The following only applies to potential borrowers. Except as otherwise stated in this section, you may cancel your registration or subscription to any Service at any time during the term of such registration or subscription or any renewal period by accessing the “Account Settings” page on your membership home page, clicking on ”Subscriptions” and clicking on “Cancel This Subscription,” and providing the information requested.
a. Controlling Law and Jurisdiction. You agree that Illinois law (without giving effect to its conflicts of law principles) will govern these Terms, the Site and the Services and that any dispute arising out of or relating to these Terms, the Site or the Services will be subject to the exclusive jurisdiction and venue of the federal and state courts in Cook County, Illinois. You acknowledge and agree that any violation of these Terms may cause PropertyGo irreparable harm, and therefore agree that PropertyGo will be entitled to seek extraordinary relief in court, including but not limited to temporary restraining orders, preliminary injunctions and permanent injunctions without the necessity of posting a bond or other security, in addition to and without prejudice to any other rights or remedies that PropertyGo may have for a breach of these Terms.
c. Securities Statements. WE MAKE NO REPRESENTATIONS, WARRANTIES OR OTHER GUARANTESS OF ANY KIND AS TO THE ACCURACY, COMPLETENESS OR TIMELINESS OF ANY PRICE QUOTES, NOR DO WE MAKE ANY REPRESENTATIONS, WARRANTES OR OTHER GUARANTESS OF ANY KIND AS TO THE PRESENT OR FUTURE VALUE OR SUITABILITY OF ANY SALE, TRADE OR OTHER TRANSACTION INVOVLING ANY PARTICULAR SECURITY OR ANY OTHER INVESTMENT OF ANY KIND. You understand that we are not a broker or dealer in securities, and not an investment or financial advisor. You are solely responsible for your investment research. Prior to undertaking any securities transaction, you should consult a broker or other financial advisor with respect to the price, suitability, value or other aspects of any stock, mutual fund, security or other investment.
You as a potential borrower, a user, a member, or any other type of user, will not submit a loan request for a home in which you intend to occupy. You understand that PropertyGo and the entire platform is for investment properties only. Any use of PropertyGo to obtain a mortgage, or loan, for a home or dwelling in which you the user will occupy to live in, will make you fully liable for all legal costs associated with such a use of the platform.
The PropertyGo platform is “direct to lender”, but PropertyGo is an intermediary for the exchange of information. For this service, PropertyGo charges a fee to its lending partners. PropertyGo does not negotiate the terms of a loan, term sheet, or other. Having certain guidelines for lenders to follow in order to make PropertyGo a platform with a positive experience across all users does not entail pre-negotiations or negotiations of any type. You as a user have all rights to not use the platform, and apply to the lenders directly on your own accord outside of PropertyGo. By using PropertyGo, you establish that you are in fact in agreement with the way the platform works, charges lenders fees, and helps to exchange information between the parties.
Some lenders require more intermediary services than other lenders. For this, PropertyGo may act as a wholesale broker, broker, or similar, to help procure and produce a loan proposal. If this is the case, it is understood that PropertyGo is doing so, on behalf of the parties, and may be acting as a broker. Any time this takes place, the fact that PropertyGo or one of its representatives or affiliated parties or companies is acting as a broker through a wholesale brokerage or lending platform of the lender, will be noted somewhere on the proposal or the summary of the proposal.
Lastly, certain loans may have a fee that will be collected by the lender or from the borrower at the funding of a loan. If such a fee is associated with any of our Services, it will be clearly stated in the “term sheet” or another section.
This website, and all other PropertyGo websites (collectively, the “Websites”) are general audience sites and we do not knowingly collect personal, or other, information from children under the age of 18. If you are under the age of 18, please do not use our site.

We collect the following information regarding your business: Name, address, telephone, size, type, and various other aspects regarding your business.
Business Documents: Some clients provide various business and personal documents to PropertyGo to provide to certain potential lenders. These documents may include personal and business tax returns in addition to other sensitive documents. Any such documents are securely stored and safeguarded. At your request and with your permission, these documents may be shared with certain lenders. Under no circumstances will we disclose, transmit, or share in any way, these documents without your permission.
Log Files: Any time you visit any of our websites, our servers automatically gather information from your browser (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks) to analyze trends, administer the site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information. For example, we may log your IP address for system administration purposes. IP addresses are logged to track a user´s session. This gives us an idea of which parts of our site users are visiting. We do not share the log files externally.
Web Beacons: ”Web beacons” (also known as “clear gifs” and “pixel tags”) are small transparent graphic images that are often used in conjunction with cookies in order to further personalize our website for our users and to collect a limited set of information about our visitors. We may also use web beacons in email communications in order to understand the behavior of our customers. We do not link the web beacons to any personally identifiable information.

We reserve the right to send you certain communications relating to the PropertyGo services, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them. We may also contact you by telephone or text message (including to any wireless number you may provide to us) solely in connection with PropertyGo’s services. If you would rather not receive telephone calls or text messages from us, you may change or delete your number from your account preferences page(s), or ask to be removed from our contact list if you receive a call or text message from us. We fully comply with the requirements of the U.S. CAN-SPAM Act. Other Sources. We may obtain information about you from third parties such as credit reports. We do not pull a credit report without your permission.

Business and financial information you provide is used to attempt to match you to an appropriate commercial real estate lender and other business products and service providers.
Disclosure By Law: You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law) and (2) protect or defend PropertyGo´s, or a third party´s, rights or property.
Lenders. By signing up for our services or submitting a request for a commercial real estate loan or service as offered on the Websites, you signify your agreement to proceed and that you are consenting, acknowledging and agreeing to the disclosure of you information with lenders within our network. We will not perform a credit check without your authorization. Please be aware that the lenders and/or other service providers with whom you are matched and with whom your information is shared may retain your information, even if you do not enter into an agreement for their products or services. Please contact each such party directly regarding their privacy and information policies. Also, if you enter into an agreement with a lender or other service provider through the PropertyGo service and make changes to the information you have provided to us, we may share the updated information with such lenders and/or service providers.
You may update or access your profile information at any time by logging into your account and making any change or update. Any changes made will be updated immediately.
If you want to stop using your account you may deactivate it or delete it. When you deactivate an account, your information will not be send to any further lenders or other third parties, but the information will not be deleted. By deactivating your account you will have the ability to restore the account in its entirety.
You may delete your account. If you choose to delete your account it will be permanently deleted from PropertyGo. You should only delete your account if you are certain you never want to reactivate it again.
PropertyGo will retain data in a commercially reasonable manner upon deletion of an account. If an account is deleted, only PropertyGo will have access to the information. No third party provider will have access to your personal information. PropertyGo will only use your data for internal research and PropertyGo marketing. Data that is retained by PropertyGo will be retained for a commercially reasonable period of time as determined by PropertyGo.
In the event there is a data breach, PropertyGo will notify you within 45 days. We will notify you that a breach occurred, what type of information was breached, when the breach occurred, what steps you can follow to further protect your information, what actions we are taking regarding the breach and what steps we are taking to ensure the breach does not happen again.
You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instruction included in these emails or you can contact us at support@PropertyGo.com.
You can choose not to provide us with certain information, but this will likely result in the inability to use certain features of the Websites and to obtain the services and products you are seeking. As a general matter, do not post personal information on public forums. You are solely responsible for the posting of any personal information on public forums.
If, after signing up for our services, you decide you no longer wish to receive our services or future contact from lenders or other third parties to which your information has been referred, you may cancel your account as discussed herein. Upon cancelling your account, your information will no longer be sent to lenders or other third parties. This does not guarantee that these lenders or other third parties will cease contacting you or using your information. Please be sure to reach out to all lenders and/or other third parties to ensure they cease contacting you.
Certain federal and state regulations require that we maintain a record of your information for certain periods of time. Due to these regulations, we may be unable to completely delete your information from our database until the time requirements of these regulations have expired.
We purchase marketing data about our customers from third parties and combine it with information we already have about you, to create more tailored advertising and products.
If you provide information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us.
Any information obtained from a third-party will be used to assist matching your loan with various lenders.
The Websites contain links to other websites that are maintained by third parties. These third parties are solely responsible for their own websites and we encourage you to reach out to such third parties for copies of and information regarding their security practices. We do not control, and are not responsible for, the privacy and security practices of these third parties.
We will not share any personal information about you with third parties to the extent prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law; and You have the right to request information from us regarding the manner in which we share certain categories of information with third parties for their direct marketing purposes. California law gives you the right to send us a request at a designated address to receive the following information: the categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year; the names and addresses of the third parties that received that information; and if the nature of the third party’s business cannot be determined from their name, examples of products or services marketed.

Vermont law places additional limits on sharing information about Vermont residents so long as they remain residents of Vermont. In accordance with Vermont law, we will not share information we collect about Vermont residents to companies outside of PropertyGo except: (1) As permitted by law; (2) To companies that perform marketing or other services on our behalf; (3) Name, contact and transaction and experience information to other financial institutions with which we have joint marketing agreements; or (4) With the authorization or consent of the Vermont resident. We also will not share non-transactional information about Vermont residents received from others within the PropertyGo family of companies except with the authorization or consent of the Vermont resident.
